Welcome to Eat What You Want, a mobile application ("App") provided by Level Up Fitness, Inc. ("Level Up Fitness," "we," "us," or "our"). By accessing or using the Eat What You Want App, you agree to comply with and be bound by the following Terms of Service ("Terms"). Please read these Terms carefully before using the App.

By accessing or using the Eat What You Want App, you agree to be bound by these Terms and any additional terms and conditions referenced herein.

2. Description of the App

The Eat What You Want App is designed to assist users in planning their meals and promoting a healthy lifestyle. It allows users to create meal plans, access nutritional information, and track their dietary preferences.

 

3. User Accounts

a. Account Creation: To use certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process.

b. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately if you become aware of any unauthorized use of your account.

 

4. Prohibited Activities

a. Hacking Attempts: Users are strictly prohibited from attempting to hack, compromise, or gain unauthorized access to our systems, servers, or databases. Any such attempts will result in immediate termination of your account.

b. Abuse of APIs: The App may utilize APIs (Application Programming Interfaces) for specific functionalities. Users must use these APIs only for their intended purposes. Any attempt to abuse, misuse, or manipulate the APIs for unauthorized activities will result in the termination of your account.

 

5. Termination of Accounts

a. Grounds for Termination: We reserve the right to terminate user accounts, at our discretion, for any violation of these Terms, including but not limited to hacking attempts, abuse of APIs, or other unauthorized activities.

b. Notification: In the event of account termination, we may provide notice to the user via the email address associated with the account.

 

6. Modifications to the Terms

We reserve the right to update or modify these Terms at any time without prior notice. The date of the last update will be indicated at the beginning of these Terms.

7. Health Disclaimer

a. No Health Guarantee: I acknowledge and understand that Level Up Fitness, Inc. makes no representations or warranties regarding the impact of its program on my specific health condition. The Eat What You Want App is intended to provide general information and support for meal planning and healthy lifestyles.

b. Not a Medical Provider: I further acknowledge and understand that Level Up Fitness, Inc. is not a medical or healthcare provider. The company does not employ individuals with degrees in medicine or nutrition on its staff.

c. No Access to Medical Records: I confirm that Level Up Fitness, Inc. has not been provided with any of my medical records to assess whether its software program and recommended meal plans may have any adverse impact on my health or medical condition.

d. Consultation with a Physician: I represent and warrant to Level Up Fitness, Inc. that I have consulted with my physician and discussed the program offered by Level Up Fitness, Inc., including its meal plans. I have received medical clearance to participate in the Level Up Fitness, Inc.'s program and meal plans.

e. Allergic Reactions: I understand and accept that Level Up Fitness, Inc. accepts no responsibility for any symptoms or conditions that may develop due to an allergic reaction to certain foods, food groups, or substances recommended by the Eat What You Want App.

 

8. User-Generated Content

a. Content Removal: We reserve the right to remove, without prior notice, any user-generated content that violates these Terms of Service or for any other reason we deem necessary at our discretion.

b. No Responsibility for User-Generated Content: Level Up Fitness, Inc. is not responsible for any user-generated content posted, shared, or uploaded by users of the Eat What You Want App. We do not endorse, verify, or guarantee the accuracy, completeness, or quality of such content.

c. User Responsibility: Users are solely responsible for the content they generate, and they acknowledge that they bear the risks associated with the use of any user-generated content, including its reliability, accuracy, and legality.

d. Compliance with Laws: Users agree that their user-generated content will not violate any applicable laws or regulations and will not infringe upon the rights of any third party.

By using the Eat What You Want App, you acknowledge that you have read, understood, and agreed to these Terms of Service.  You further confirm that you have taken the necessary steps, including consulting with a qualified healthcare professional, to ensure that my participation in the Level Up Fitness, Inc.'s program is safe and appropriate for your individual health circumstances. Level Up Fitness, Inc. reserves the right to take appropriate action, including content removal, and/or account termination in response to any violation of these provisions.
